This is a great pair of waterproof trousers. I am just back from an expedition in Mongolia. The trousers were warm and waterproof and strong.
Only downside is the velcro fastenings at the top are not strong enough, and often popped open. A snap button at the top, like at the bottom of the trousers would be better.

How do they fit over hiking pants? I wear a 38 waist, should I buy the XL, or size up to ensure they fit over my normal pants?

  They are designed to fit over a mid to lightweight layer, so your hiking pants should fit fine under the pants in your normal size.

  I would recommend a medium. Relaxed, the waist is 31in, but can easily be stretched with the elastic waist to accomidate layers. The inseam is 31in. Thanks for your question!
